DFARS 239.7409 Special assembly.

The codified text (eCFR, as of 2026-10-02). Under the Revolutionary FAR Overhaul ↗, agencies follow class deviations with new text for many parts while the formal rules go through the Federal Register: check the solicitation and your contract's clauses, which rule.

In plain English

This section defines special assembly as designing, manufacturing, arranging, assembling, or wiring equipment to provide telecommunications services that cannot be provided with general use equipment. It requires that special assembly rates and charges be based on estimated costs, and that the contracting officer should negotiate them before service starts. If advance negotiation isn't possible, provisional rates subject to adjustment are used until final rates are negotiated, and the authorizing CSAs must be modified to reflect the final rates.

Applies to: Contracting officers and contractors involved in special assembly for telecommunications services

What it requires

  • Base special assembly rates and charges on estimated costs.
  • Negotiate special assembly rates and charges before starting service when possible.
  • Use provisional rates and charges subject to adjustment when advance negotiation is not possible.
  • Modify the CSAs authorizing the special assembly to reflect negotiated final rates and charges.
