FAR 3.101-2 Solicitation and acceptance of gratuities by Government personnel.

The codified text (eCFR, as of 2026-10-02). Under the Revolutionary FAR Overhaul ↗, agencies follow class deviations with new text for many parts while the formal rules go through the Federal Register: check the solicitation and your contract's clauses, which rule.

In plain English

This section states that Government employees generally may not solicit or accept gratuities, gifts, favors, entertainment, loans, or anything of monetary value from certain outside parties, including contractors who have or seek Government business with their agency. It matters to contractors because offering such items to Government personnel is restricted, though agency regulations may authorize limited exceptions.

Applies to: Government employees and contractors who have or seek Government business with an agency

Key terms: gratuity · gift · favor · entertainment · loan
