FAR and DFARS › FAR Part 35: Research and Development Contracting
FAR 35.011 Data.
The codified text (eCFR, as of 2026-10-02). Under the Revolutionary FAR Overhaul ↗, agencies follow class deviations with new text for many parts while the formal rules go through the Federal Register: check the solicitation and your contract's clauses, which rule.
In plain English
This section says that research and development contracts must state exactly what technical data the contractor has to deliver, because the standard data clauses in FAR Part 27 do not by themselves require delivery of any data. It also advises that when later production contracts are expected, planners should consider the need and time to get a technical package that allows competition for production. This matters because a contractor on an R&D contract only owes the data the contract specifically calls for.
Applies to: R&D contracts and agencies planning developmental programs
What it requires
- Specify in the R&D contract the technical data to be delivered under the contract
Key terms: technical data · R&D contracts · data clauses · technical package · developmental contractor

The text
(a) R&D contracts shall specify the technical data to be delivered under the contract, since the data clauses required by part 27 do not require the delivery of any such data.
(b) In planning a developmental program when subsequent production contracts are contemplated, consideration should be given to the need and time required to obtain a technical package (plans, drawings, specifications, and other descriptive information) that can be used to achieve competition in production contracts. In some situations, the developmental contractor may be in the best position to produce such a technical package.
