FAR and DFARS › FAR Part 36: Construction and Architect-engineer Contracts › Subpart 36.5
FAR 36.503 Site investigation and conditions affecting the work.
The codified text (eCFR, as of 2026-10-02). Under the Revolutionary FAR Overhaul ↗, agencies follow class deviations with new text for many parts while the formal rules go through the Federal Register: check the solicitation and your contract's clauses, which rule.
In plain English
This section tells the contracting officer when to include the Site Investigation and Conditions Affecting the Work clause in certain fixed-price construction, dismantling, demolition, or removal contracts. It matters to contractors because that clause affects how site conditions are handled, and whether it appears depends on the contract type and expected dollar value relative to the simplified acquisition threshold.
Applies to: Contracting officers awarding fixed-price construction or dismantling, demolition, or removal of improvements contracts
What it requires
- Insert the clause at 52.236-3 in solicitations and contracts when a fixed-price construction contract or a fixed-price dismantling, demolition, or removal of improvements contract is contemplated and the contract amount is expected to exceed the simplified acquisition threshold
