FAR and DFARS › FAR Part 52: Solicitation Provisions and Contract Clauses › Subpart 52.2
FAR 52.222-36 Equal Opportunity for Workers with Disabilities.
The codified text (eCFR, as of 2026-10-02). Under the Revolutionary FAR Overhaul ↗, agencies follow class deviations with new text for many parts while the formal rules go through the Federal Register: check the solicitation and your contract's clauses, which rule.
In plain English
This clause requires contractors to follow the equal opportunity requirements at 41 CFR 60-741.5(a), which prohibit disability discrimination and require affirmative action to employ and advance qualified individuals with disabilities. Contractors must also flow these terms down into covered subcontracts or purchase orders above the FAR 22.1408(a) threshold. It matters because it creates compliance and subcontracting obligations tied to disability nondiscrimination and affirmative action.
Applies to: Contractors and their covered subcontractors or vendors
What it requires
- Abide by the equal opportunity clause requirements at 41 CFR 60-741.5(a), as of March 24, 2014.
- Include the terms of this clause in every subcontract or purchase order in excess of the FAR 22.1408(a) threshold on the date of subcontract award, unless exempted.
- Act as specified by the Director, Office of Federal Contract Compliance Programs of the U.S. Department of Labor, to enforce the terms, including action for noncompliance.
