FAR and DFARS › FAR Part 52: Solicitation Provisions and Contract Clauses › Subpart 52.2
FAR 52.239-1 Privacy or Security Safeguards.
The codified text (eCFR, as of 2026-10-02). Under the Revolutionary FAR Overhaul ↗, agencies follow class deviations with new text for many parts while the formal rules go through the Federal Register: check the solicitation and your contract's clauses, which rule.
In plain English
This clause restricts the contractor from publishing or disclosing details of security safeguards designed, developed, or provided under the contract without the Contracting Officer's written consent. It also requires the contractor to give the Government access to its facilities, operations, records, and databases for inspection to protect Government data, and to promptly report any new threats or failed safeguards. It matters because it imposes confidentiality and cooperation duties on contractors handling Government data.
Applies to: Contractors under contracts that include this clause
What it requires
- Do not publish or disclose safeguard details without the Contracting Officer's written consent
- Provide the Government access to facilities, installations, technical capabilities, operations, documentation, records, and databases for inspection
- Immediately notify the other party if new or unanticipated threats or hazards are discovered or if existing safeguards have ceased to function
