FAR and DFARS › FAR Part 19: Small Business Programs › Subpart 19.3

FAR 19.301-3 Rerepresentation by a contractor that represented itself as other than a small business concern.

The codified text (eCFR, as of 2026-10-02). Under the Revolutionary FAR Overhaul ↗, agencies follow class deviations with new text for many parts while the formal rules go through the Federal Register: check the solicitation and your contract's clauses, which rule.

In plain English

This section allows a contractor that previously represented itself as not small to voluntarily rerepresent its size status as small. It can do so only if the conditions in 19.301-2(b) apply and it qualifies as small under the size standard in effect at the time of rerepresentation. This matters because it gives such a contractor a path to be treated as small for future actions, but the rerepresentation is optional.

Applies to: Contractors that represented themselves as other than small before contract award

Key terms: rerepresent · size status · small business concern · size standard · contract award
