FAR and DFARS › FAR Part 52: Solicitation Provisions and Contract Clauses › Subpart 52.2

FAR 52.203-2 Certificate of Independent Price Determination.

The codified text (eCFR, as of 2026-10-02). Under the Revolutionary FAR Overhaul ↗, agencies follow class deviations with new text for many parts while the formal rules go through the Federal Register: check the solicitation and your contract's clauses, which rule.

In plain English

This provision requires an offeror to certify that its prices were set independently, without collusion or disclosure to competitors, and without attempts to restrict competition. It matters because signing the offer creates a binding certification, and any exception to the non-disclosure rule must be explained in a signed statement.

Applies to: Offerors submitting bids or proposals under solicitations that include this provision

What it requires

  • Certify that prices were arrived at independently without consultation or agreement with competitors.
  • Certify that prices have not been and will not be knowingly disclosed to competitors before bid opening or contract award, unless required by law.
  • Certify that no attempt has been made or will be made to induce another concern to submit or not submit an offer to restrict competition.
  • If deleting or modifying subparagraph (a)(2), furnish a signed statement detailing the circumstances of the disclosure.
