FAR and DFARS › FAR Part 4: Administrative and Information Matters › Subpart 4.12
FAR 4.1202 Solicitation provision and contract clause.
The codified text (eCFR, as of 2026-10-02). Under the Revolutionary FAR Overhaul ↗, agencies follow class deviations with new text for many parts while the formal rules go through the Federal Register: check the solicitation and your contract's clauses, which rule.
In plain English
This section tells contracting officers when to include the Annual Representations and Certifications provision (52.204-8) in solicitations, and when to use its Alternate I. It also lists many individual representation and certification provisions that should not be included separately when the System for Award Management provision (52.204-7) is already in the solicitation. Contractors see this as the rule that consolidates many required certifications into one annual submission rather than repeating them individually.
Applies to: Contracting officers preparing solicitations and contracts, and offerors responding to them
What it requires
- Insert the provision at 52.204-8 in solicitations, except solicitations for commercial products or commercial services under part 12
- Check the applicable provisions at 52.204-8(c)(2)
- Use Alternate I in solicitations issued after October 1, 2028 that will result in a multiple-award contract with more than one NAICS code assigned
- Do not separately include the listed representations and certifications when 52.204-7 is in the solicitation
