In plain English

This DFARS provision requires an offeror to represent, when submitting an offer, that the unit price in the offer does not exceed the offeror's established price in effect on the bid opening date (or contract date for negotiated contracts) for like quantities of the same item. It matters because the offeror must confirm its pricing is consistent with its own established price, net of standard trade discounts.

Applies to: Offerors submitting offers for basic steel, aluminum, brass, bronze, or copper mill products

What it requires

  • By submitting an offer, represent that the unit price stated in the offer is not in excess of the offeror's established price in effect on the date set for opening of bids, or the contract date if negotiated, for like quantities of the same item
  • Identify the item in the offer
