FAR 33.209 Suspected fraudulent claims.

The codified text (eCFR, as of 2026-10-02). Under the Revolutionary FAR Overhaul ↗, agencies follow class deviations with new text for many parts while the formal rules go through the Federal Register: check the solicitation and your contract's clauses, which rule.

In plain English

This section requires the contracting officer to refer a matter to the agency's fraud investigation official if the contractor cannot support part of a claim and there is evidence that the inability is due to misrepresentation or fraud. It matters because it can lead to a fraud investigation when a claim lacks support and fraud is suspected.

Applies to: Contractors who submit claims that they cannot fully support.

Key terms: claim · misrepresentation of fact · fraud · contracting officer · agency official responsible for investigating fraud
